General terms and conditions
Here you can find the general terms and conditions of Atike's Creations.

Article 1: General provisions
The e-commerce website of Atike's Creations offers its customers the possibility to buy the products from its webshop online.
When placing an order through the web store of Atike's Creations, the Client must explicitly accept these Terms and Conditions, by which he agrees to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional conditions of the Client are excluded, except if they have been accepted beforehand, in writing and explicitly by Atike's Creations.
Article 2: Price
All prices mentioned are in EURO, always including VAT and excluding shipping costs. These shipping costs will be determined at checkout.
The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
The price of the pacifier strings changes according to the number of letter blocks used.
For shipping, a choice can be made for regular letterbox mail or with track and trace via Bpost. (only for Belgium).
For abroad there is also a choice for regular mail or with track and trace.
Shipment of regular mailbox mail is at the customer's own risk. Atike's Creations is not responsible for loss or damage during shipment.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date.
If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we ask the Customer to contact us in advance by e-mail to info@atikescreations.be.
The offer is always valid as long as stocks last and can be adjusted or withdrawn at any time by Atike's Creations. Atike's Creations cannot be held liable for the unavailability of a product. When a product is unavailable, a longer delivery period may apply. The client will be informed of this by Atike's Creations. If an offer has a limited period of validity or is made under conditions, this will be explicitly mentioned in the offer.
Images of products are a true representation of the offered products. Atike's Creations cannot guarantee that the colors shown correspond exactly with the real colors of the products.
Article 4: Online purchases
When placing an order you will receive a confirmation e-mail with the chosen method of payment. Here you will see a total cost including VAT and including shipping costs chosen by the customer. The products made by us will be shipped as soon as the payment has been made.
The customer has the choice of different payment or cash on pickup at home.
Atike's Creations can refuse the order if there is no payment to proceed to payment within 14 days after order confirmation. The client will first receive a reminder to pay by email.
Atike's Creations has the right to refuse an order due to a serious shortcoming of the Client with regard to orders in which the Client is involved.
Article 5: Delivery and execution of the agreement
The delivery is done by Bpost in Belgium and for foreign shipments this may differ. The Customer is responsible for the correct transmission of address details. Atike's Creations cannot be held liable for this.
Unless otherwise agreed or explicitly stated, the goods will be delivered to the domicile of the Client within 10 days after receipt and payment of the order. If the term of delivery would be longer for one reason or another, the Client will be informed by Atike's Creations.
Any visible damage and/or qualitative shortcoming of an article or any other shortcoming in the delivery, must be immediately reported by the Client to Atike's Creations by e-mail: info@atikescreations.be.
The risk of loss or damage transfers to the Client as soon as he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Client upon delivery to the carrier, if the carrier has been instructed by the Client to transport the goods and this choice was not offered by Atike's Creations.
Article 6: Retention of title
The delivered articles remain the exclusive property of Atike's Creations until the moment of full payment by the Client.
The Client undertakes, if necessary, to inform third parties of the retention of title of Atike's Creations, e.g. to anyone who would seize the not yet fully paid articles.
Article 7: Right of withdrawal
The provisions of this article only apply to Clients who, in their capacity as consumers, purchase articles online from Atike's Creations. Please note: this does not apply to personalized items with a name!
The direct costs of returning the goods will be borne by the Client.
The Client is requested to return the items in their original condition and packaging, with all accessories supplied with them, and instructions for use. Once the item has arrived back at Atike's Creations, the amount of the items will be refunded excluding (shipping costs not included).
If the returned product has been reduced in value in any way, Atike's Creations reserves the right to hold the Client liable and to claim damages for any reduction in value of the goods resulting from the use of the goods by the Client that goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.
Article 8: Privacy
The data controller, Atike's Creations, respects the Belgian law of 8 December 1992 relating to the protection of privacy in the processing of personal data.
The personal data you provide will only be used for the following purposes:
- The execution of the concluded agreement
- Processing and shipment of orders
We treat your data as confidential information and will not pass it on, rent or sell it to third parties.
The customer is responsible for keeping his login details confidential and the use of his password. Your password will be stored encrypted, so Atike's Creations will not have access to your password.

Article 9: Modification of conditions
These Terms and Conditions are supplemented by other terms and conditions to which explicit reference is made, and the general terms and conditions of sale of Atike's Creations. In case of contradiction, these Terms and Conditions prevail.
Article 10: Applicable law - Disputes
Belgian law is applicable, with the exception of the provisions of private international law on applicable law.

PRIVACY GENERAL
Atike's Creations respects the privacy of all users of its site and ensures that personal information is treated confidentially. We use your information to process orders as quickly and easily as possible. For all other purposes, we will only use this information with your permission.
Atike's Creations uses the collected information for the following purposes:
- To keep you informed about your order
- To be able to ship your order to the right address
- The processing of a possible return
SAVE DATA + LOGIN
If you place an order at Atike's Creations we keep your data on a Secure Server. You can enter a username and password as well as your name and address, phone number, email address, delivery and payment information, so you don't have to fill them in with every new order.
Data processor JouwweB
For managing and sending your orders we use Jouwweb. This software processes the orders and your personal data such as name + address + email address + telephone number + any comments + order. In order to be able to ship your order quickly and correctly and to be able to contact you.
Atike's Creations does not sell your information
Atike's Creations will not sell your personal information to third parties and will only provide your personal information to third parties that are involved in processing your order.
RETENTION PERIOD DATA
The personal data can be removed upon request after the legal retention period has expired. A statutory retention period for orders, is the period set by the Belastingdienst at 7 years. It is necessary to keep the purchase data and your personal data during this period. Other data that are not necessary for the administration can be removed earlier on request.
You have the right to inspect, rectify and delete your data. You can request this via info@atikescreations.be. This is subject to the above mentioned point that some data must be kept for the Tax and Customs Administration.
Cookies
Cookies are small pieces of information that your browser stores on your computer. Atike's Creations uses cookies to recognize you on your next visit. Cookies enable us to collect information about the use of our services and to improve and adapt them to the wishes of our visitors. Our cookies provide information related to personal identification, no consent is required. However, you can set your browser so that you do not receive cookies while shopping at Atike's Creations.
We use Google Analytics, Google places cookies from this site to the visitor in order to collect the necessary information. These cookies are excluded from the cookie law and you do not need to give permission for this. There is a new exception ground added to the law, under which Google Analytics can be classified. Services that are used to obtain information about the quality or effectiveness of a service provided can be exempted from the cookie law if these services do not or only marginally infringe on privacy.
